AGREEMENT BETWEEN YOU AND LAWYERS ONLINE

These General Terms and Conditions (“Terms”) are an agreement between you and Houghton Legal LLP trading as Lawyers Online and cover your use of the information, products and services made available through www.lawyersonline.co.uk (“the Website”).

By using the Website, you agree to the website-use Terms. Our Privacy Policy explains how we handle personal information.

Where you book legal services, the relevant service terms below and your client care letter also apply. Any different terms expressly agreed in your client care letter take precedence over these general service terms.

USE OF THE WEBSITE

You are responsible for making the arrangements necessary to access the Website and for ensuring that persons accessing it through your internet connection are aware of these Terms.

Please read these Terms carefully before using the Website. You must be at least 18 years old to book our services through the Website.

The contents of this Website are protected by copyright owned by Lawyers Online or its licensors. Copyright notices must remain on permitted reproductions of material obtained from the Website.

General information on the Website does not constitute legal advice tailored to your circumstances. Browsing the Website or downloading general information does not, by itself, create a solicitor-client relationship.

Instructions for legal services are governed by our booking process, client care letter and applicable service terms.

The Website may contain links to external sites outside our control. We do not endorse or accept responsibility for their content. Nothing in these Terms excludes liability that cannot lawfully be excluded.

INDEPENDENT LEGAL ADVICE SERVICES

Our Independent Legal Advice service is limited to advising on the documents covered by your booking and, where appropriate, completing the associated solicitor’s certificate or confirmation of advice.

We act for the person receiving the advice. Payment by another person or a company does not change who our client is.

Our advice is limited to the law of England and Wales. Unless separately agreed in writing, this service does not include conveyancing, drafting or negotiating transaction documents, or tax or financial advice. We do not hold transaction funds or provide conveyancing undertakings.

The solicitor allocated to your appointment will have responsibility for your matter. Rosie Houghton is our managing partner and oversees our service.

We must receive the necessary documents and satisfactory identification before completing our work. We may request further information or explain that a matter falls outside our fixed-fee service.

Please follow the signing and witnessing instructions supplied for your particular documents. Checking a witness’s identity does not mean that our firm witnessed the signature.

FEES AND PAYMENT

The fee, including VAT where applicable, will be displayed during booking and confirmed in your client care letter.

Any additional work or fee must be agreed with you before it is undertaken.

Payments are processed through Stripe. Please provide the correct name and address for your invoice.

CANCELLATION AND MISSED APPOINTMENTS

Please contact us promptly if you need to cancel or rearrange your appointment.

Please give at least 24 hours’ notice of cancellation. Subject to your statutory rights, cancellations with less than 24 hours’ notice or missed appointments may incur a reasonable charge reflecting our actual loss, taking account of costs saved and whether the appointment is filled. Any balance due to you will be refunded.

Statutory cancellation rights

Where you book online or by telephone as a consumer, you will generally have 14 days from entering into the contract to cancel without giving a reason.

To cancel, send a clear statement to advice@lawyersonline.co.uk or our Broadway office. You may use the cancellation form below, but this is optional. To meet the deadline, send your cancellation before the cancellation period expires.

Where a statutory refund is due, we will make it within 14 days of being informed of your cancellation, using the original payment method unless otherwise agreed, without charging a refund fee.

If you expressly request us to begin work during the cancellation period, including reviewing documents, you may be required to pay proportionately for services performed before you cancel, where permitted by law.

Your statutory cancellation right ends once the service is fully performed only where you have expressly requested early performance and acknowledged that consequence. We obtain that request and acknowledgment separately.

These provisions do not limit your other statutory rights.

COMPLAINTS

We strive to provide a quality service and constantly seek to improve our service standards.

If you are unhappy with our service or fees, please contact the solicitor handling your matter or Rosie Houghton at advice@lawyersonline.co.uk.

Our Complaints Procedure at www.lawyersonline.co.uk/complaints explains how we handle complaints and when you may approach the Legal Ombudsman. Complaints are handled without charge.

DATA PROTECTION

Personal information is handled as explained in our Privacy Policy at www.lawyersonline.co.uk/privacy, which covers website visitors, enquiries, clients and witnesses.

PROFESSIONAL INDEMNITY INSURANCE AND LIABILITY

We maintain professional indemnity insurance meeting the SRA’s requirements. Details of our insurer and territorial coverage are available on request.

Any agreed limitation of liability for our legal services is set out in your client care letter. Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted.

CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes to the website-use Terms apply to future use of the Website. Changes will not retrospectively alter an existing engagement unless agreed with you or required by law.
